Fact:
Here servant deposited some rubbish
carefully on the path of the plaintiff as authorized by his master. In curse of
time a portion of it touch the plaintiff’s wall.
Issue:
Whether there is any injury or not?
Judgment:
The defendants was liable for trespass.
Reasoning:
The defendants does not have any legal
right for trespass on plaintiff’s land. So there was injury to the plaintiff
and here loss is created by an unlawful act and this is trespass.
