Nichols v. Marsland


Fact:

 Due to extraordinary rainfall of unprecedented violence the defendant's artificial lakes by damming up a natural steam, both the steam and lakes swelled to such an extent that ultimately artificial banks brust and some bridges were carried away by escaping water.

Issue:

The defendant, would be liable or not?

Judgment:

The court held that there was no liability

Reasoning:
Cause of the flood was an act of God and that was proved I court
