Fact:
The accident was happened by the negligent driving of the conductor and that conductor was only permitted for conducting not for driving.
Issue:
Here, who would be held liable muster or servant?
Judgment:
Master was not be liable.
Reasoning:
The conductor was driving and that was not permitted by the employer it cannot be within the course of employment and the master was not be liable.
